The Raffles Apartments Napier – Frequently Asked Questions

What am I purchasing?

You are purchasing a Stratum in Freehold comprising of the apartment and a share of land and common areas to be described on the Certificate of Title.

Has the Development got Building Consent?

Building Consent 1 which includes piling, foundation works and the building superstructure has been issued and construction has commenced. Building Consent 2 which includes the architectural envelope and internal fit out has been lodged with NCC and is in process.

Has a Construction Company been Appointed?

What is the Estimated Completion Date?

Completion of the build is planned for the third quarter of 2024.

Is my Deposit Safe?

Yes, your 10% deposit will be held in the developers Solicitors Trust Account securely and independent of the developer. Net interest accrued until settlement and will be credited to you and deducted off your purchase price on settlement.

Is there a Body Corporate?

Yes, there is a Body Corporate for the development. There will be an annual fee which pays for the maintenance of the shared areas such as gardens on and around the driveway, stormwater pumps and drains, power for the driveway lighting. Building insurance and administration of the Body Corporate will be included in the annual cost. See the draft rules and budget in the How to Purchase section of the website.

Can the Developer Increase Prices to meet rising Building Costs?

  • The developer cannot increase the price of the apartment and auxiliary unit(s) once the contract is unconditional.

Can I make changes to my apartment?

  • The design and specification of each apartment is presented on the website and in the contract. The developer offers limited personal options to the specifications at the time of contracting. Once your contract is accepted there can be no further changes.

Can the developer make Variations to the Outline Specifications?

  • If any materials referred to in the Plans and Specifications are unable to be procured on reasonable terms in a timely manner or are prohibited by law or other requirement, the vendor may substitute other building items provided they are of a standard as near as reasonably practicable to the building items referred to in the Plans and Specifications.

What are the Building Warranties?

There are warranties for the benefit of the Owners. Warranties are provided by the construction company, suppliers of materials, and products for the construction of the buildings.

  • Owners will receive warranties on appliances and chattels used in the construction of the apartments and provided by the suppliers.
  • Some building materials e.g., electrical and plumbing are warranted by the suppliers within their Producer Statements.
  • There are implied warranties in the agreement for sale and purchase under The Building Act 2004. They are for 10 years and cover almost all aspects of the building works for compliance with the building code.

Builders Maintenance Warranty

  • The builder will provide a Builders Maintenance Warranty providing 12 months for notification and rectification of defects. All building warranties will be in accordance with the NZ Building Act 2004.

Stamford Guarantees and Warranties

  • There will be a 10-year comprehensive building guarantee and warranties issued upon completion of the building.

Will the homes be Watertight?

  • The apartments have been designed by Pacific Architecture who are internationally respected hotel and apartment development architects, and built by a reputable builder. Also on the consultant team are Meinhardt Group whom as an International Engineering consultancy are retained to oversee all works to the building facade to ensure it will fully comply with the weather tightness and durability requirements of the New Zealand Building Code as part of obtaining a Code of Compliance on completion..
  • The builder will provide a Weathertightness Warranty for 10 years upon completion of the building.

Can I operate an Airbnb accommodation service.

  • You can rent your apartment on a short-term basis. Your tenants will comply with all the rules imposed on tenants of the apartment owners by the Body Corporate and subject to the jurisdiction of The Tenancy Tribunal.

Am I allowed to keep pets in my home?

  • Yes, with reasonable approvals required from the Body Corporate.

What happens to Rubbish and Recycling?

  • The Body Corporate will provide a weekly rubbish collection service and is paid by the owners in the annual levy.

What Internet and Media Connections are supplied to my Home?

The following will be connected to each apartment.

  • Chorus fiber network providing hi-speed internet connection
  • Digital TV connection providing a Freeview signal
  • Satellite connection pre-wired and ready for installation
